Thailand: National Phase Applications in Thailand

On 24 September 2009, the Thailand's Deputy Commerce Minister and Director General of the Department of Intellectual Property submitted the instrument of accession to the PCT with the World Intellectual Property Organisation. The Treaty entered into force on 24 December 2009, and Thailand became the 142nd contracting party of the PCT.

 

Hence, PCT applications with an International Filing Date on or after 24 December 2009 and designating Thailand would be able to enter the Thai national phase within 30 months from the earliest priority date. We expect that the earliest date by which a PCT application can be nationalised in Thailand would be 24 June 2011.

 

In order to file a Thai national phase application, we would require the PCT application number as well as amendments filed during the PCT International phase (if any). We can then prepare the Thai translation at our end.

 

IMPORTANT note about deadline to file Thai translations: The Thai translation must be furnished at the time of national phase entry. There are currently no provisions for late filing of the translated patent specification. Hence, please give us your instructions at the latest two months before the 30th month deadline so that we can prepare and file the Thai translation in a timely manner.

 

The following formal documents are required.

General Power of Attorney (which has to be signed and notarised)

Assignment document (in cases where the applicant(s) is not the same as those filed in the PCT)

 

The above documents can be submitted within 90 days after the Thai filing date (further extensions of 90 days followed by 30 days are available).

 

For a national phase application, the deadline to request for examination is 5 years from the Thai publication date.
